More on the Chamber of Commerce

The Chamber of Commerce has no discernable connection with trademarks; it has no expertise in trademarks.  Yet the Chamber of Commerce was invited by the White House to participate in discussions of the trademark aspects of a proposed and now final Hague Convention on Enforcement of Foreign Judgments.  At the discussions, the Chamber of Commerce advocated for positions that in fact benefitd no one, but which it thought benefited Disney, Microsoft, and other mega-trademark owners.  At the diplomatic conferences on the then-proposed Convention, the Chamber of Commerce was allowed to participate, although Hague rules permit only international organizations to participate.  It was quite clear at those conferences that the Chamber of Commerce had its marching orders from Disney, Microsoft et al.  In fact, the positions advocated by the Chamber of Commerce were detrimental to smaller businesses and businesses generally; the Chamber advocated, for example, that foreign judgments obtained by substantive fraud should be enforceable worldwide.  It was quite clear also that the positions advocated by the Chamber of Commerce had not been the result of consultations with its entire membership; my guess is that none of those positions were ever put to its membership.
